People v. LVC – DUI with 0.18 breath tests

Young woman arrested for first offense DUI. Two breath tests with results of 0.18 each, more than twice the legal limit. We scheduled a motion to suppress evidence and a Pitchess motion (a motion to find out if citizens have filed complaints against this police officer).

The District Attorney dismissed all the charges.  Our client has no criminal record or driver's license suspension.

People v. SC – DUI with 0.11 Breath Test

Young woman arrested for DUI.  Two breath tests both showed alcohol level of 0.11.  We took the case to a jury trial. 

The jury found her NOT GUILTY of all charges!

People vs. MND – DUI with 0.28% Blood Test

Woman charged with driving under the influence of alcohol.  Her blood test showed an alcohol level of 0.28%, two and a half times the legal limit.

We took the case to a jury trial.  The jury found her NOT GUILTY of all charges!

People v. CIE – DUI with 0.08 Breath Test

Young woman charged with DUI.  Her breath test results were 0.08 and 0.09.

All criminal charges were dismissed! 

People v. RG – Felony DUI with Injury

Young man charged with felony DUI with injury.  His car hit a tree and his passenger went through the windshield.  The driver and the passenger with both transported by  ambulance to the emergency room.  He faced up to SIX YEARS IN PRISON.  After extensive investigation and negotiations with the prosecutor, he pled to a misdemeanor and spent two weeks in county jail.  No prison time.  No felony conviction on his record.

People v. CJ – Driving under the Influence of Marijuana

Young man charged with marijuana DUI.  We filed a motion to suppress evidence and convinced the judge that the police violated our client's constitutional rights. 

The criminal charges were dismissed.  He pled to a traffic ticket and paid a fine.

People v. SJ – DUI with 0.18 Breath Test

Young woman stopped by police for allegedly failing to stop at pedestrian crosswalk.  Her breath test result was 0.18, more than twice the legal limit. We filed a motion to suppress evidence based on an unlawful detention.  The judge granted our motion. 

The criminal charges were dismissed!

People v. DK – Second Offense DUI

Young man charged with DUI with a prior DUI conviction and with refusing to take blood or breath test.  We set the case for a jury trial. 

On the eve of trial, the prosecutor moved to dismiss all criminal charges.

People vs. ZRL – Driving under the Influence of Marijuana

18-year-old stopped by CHP while driving 90+ mph on Highway 1.  He was arrested and charged with driving under the influence of marijuana, with a speeding enhancement, and with an infraction for possession of marijuana.

The criminal charges were dismissed!  He pled to a speeding ticket and paid a fine.

People v. CM – DUI with 0.15 breath test

Woman arrested for DUI.  She took two breath tests with results of 0.15 and 0.15, almost twice the legal limit.  We took the case to a jury trial. 

On the third day of trial, the prosecutor moved to dismiss all criminal charges.

People v. KLM – DUI with 0.16 Blood Test

Young man arrested for DUI with a blood test result of 0.16, twice the legal limit. We set the case for a jury trial. 

On the eve of trial, the prosecutor moved to dismiss all criminal charges.

People v. MPM – Driving under the Influence of a Drug

A combat veteran and former firefighter suffering from traumatic brain injury, was arrested twice in a two-month period by the same CHP officer. In one case, he was charged with driving under the influence of a drug. In the other, he was charged with driving under the combined influence of alcohol and a drug.

In both cases, all criminal charges were dismissed.

People v. EMR – DUI with 0.14 breath test

Firefighter arrested for DUI with breath test results of 0.14 and 0.15. He faced losing his job if convicted.

We took the case to trial and the jury found him NOT GUILTY!

People vs. MCS – DUI with 0.10 Breath Test

Vietnam veteran arrested by CHP. He had four breath tests showing a blood alcohol level of 0.11, 0.11, 0.10, and 0.10. He was charged with DUI and driving without a license. We filed a motion to suppress evidence.

All criminal charges were dismissed!

People v. AIV – DUI with 0.09 Breath Test

Young man arrested by CHP.  Four breath tests showed results of 0.09, 0.09, 0.08, and 0.08.  We took the case to a jury trial.  The jury found him NOT GUILTY of all charges!

People v. MSZ – DUI with 0.18 Breath Test

Plumber charged with DUI.  His breath test results were 0.18 and 0.19.  He faced losing his job if convicted.  We set the case for a jury trial. 

On the morning of trial, the prosecutor moved to dismiss all criminal charges.
