NOT GUILTY ON DUI WITH 0.17% BREATH TEST RESULT.

Our client was pulled over for allegedly swerving between lanes.  According to the police officer, she had slurred speech, an odor of alcohol, bloodshot eyes, and an unsteady gait.  The officer asked her to do field sobriety tests.  Her performance was terrible.  She could not balance on one foot for more than a few seconds.

She took three breath tests, and the results were 0.18, 0.17, and 0.17.  She was arrested for a first offense DUI and taken to jail.

If convicted, she faced losing her job and not being able to provide for her two children.

We took the case to a jury trial.  After a four-day trial and four hours of deliberation, the jury found her NOT GUILTY.
